A government team and Dr Tahirul Qadri will hold discussions regarding dissolution of the Election Commission of Pakistan and its reformation at Minhajul Quran International in Lahore on Sunday. The talks are part of Islamabad Long March Declaration.
It was decided in the declaration that the government allies and Pakistan Awami Tehreek will present two names for caretaker prime minister after complete consensus. Assemblies will be dissolved before their due date which ends of March 16. General Elections will be held 90 days after the assemblies are dissolved. Thirty days will be fixed for the verification of members who want to run election. The verification will be according to the articles 62 and 63 of the Constitution.
A issue which created hurdles for Dr Tahirul Qadri and govt team was reformation of the Election Commission of Pakistan. It was decided that a meeting will be organised in MQI secretariat Lahore to resolve the issue after taking consultation with legal experts.
Renowned legal experts including SM Zafar, Khalid Ranjha, Aitzaz Ahsan, Abdul Latif Afridi, Farogh Naseem and Professor Humayun Ahsan have told Federal Law Minister Farooq H Naek that any member of the EC commission could not be removed as per Constitution. They told that constitutional amendment was necessary for reformation of the EC.
The experts also told Naek that EC was formed according to article 218 of the Constitution.
Any member of the EC could remove only according to the Article 209 of the Constitution that is Presidential ordinance.
